U.S. puts Canada on pharma patents watch list | Legal Post ...

The U.S. has placed Canada on its 2013 ?Watch List? because of ?serious concerns? over the treatment of pharmaceutical patents.

Jason Markwell and Patrick Kierans, writing in the firm?s Pharma In Brief, note that the U.S. Trade Representative?s annual IP report for 2013?expresses concerns related to the lack of appeal rights for innovative companies under the Patented Medicines (Notice of Compliance) Regulations?and to ?the impact of recently adopted heightened utility requirements? which, the Report alleges, does not conform with NAFTA and TRIPS.

?The USTR?s comments come at a time when challenges to Canada?s new utility requirements have been raised in a NAFTA Chapter 11 proceeding initiated by Eli Lilly against the Government of Canada and in various scholarly publications.,? the Norton Rose lawyers write.
